Decreto Flussi: Can a Delay in Submitting the Residence Contract Lead to Rejection? Welcome to a new episode of the Immigration Law podcast. I am Attorney Fabio Loscerbo. Today we discuss an important decision concerning the seasonal work permit under Italy's Decreto Flussi. We are examining a judgment of the Regional Administrative Court for Emilia-Romagna, published on 10 July 2026, issued in General Register case number 808 of 2026. The case involved an Egyptian national who legally entered Italy with a seasonal work visa. Although the residence contract had been signed and the worker had already started employment, the Immigration Office closed the application because the digitally signed residence contract had not been submitted within the statutory deadline. The Court ruled in favor of the worker. It emphasized that Italian law expressly protects foreign workers when the delay is caused by force majeure or by circumstances that are not attributable to them. For this reason, the authorities must first inform both the employer and the worker of the missing documentation and allow them to explain the reasons for the delay before taking any adverse decision. According to the Court, this prior notification is not a mere procedural formality but a fundamental safeguard of the right to participate in the administrative process. Without it, the worker is deprived of the opportunity to prove that the delay was not his responsibility. The Court therefore annulled the decision and ordered the Prefecture to reopen the procedure, set a deadline for the parties to submit the properly signed residence contract, and reconsider the application in accordance with the legal principles established in the judgment. This decision reinforces an important principle: under the Decreto Flussi, procedural delays cannot automatically be held against a foreign worker without first giving that person a genuine opportunity to demonstrate that the delay was beyond their control.
