Special Protection and Conversion into a Work Permit: When the Police Authority’s Refusal Is Lawful Welcome to a new episode of the podcast “Immigration Law”. My name is Fabio Loscerbo, immigration lawyer. Today we are discussing a decision of the Regional Administrative Court of Justice of Trento, issued on 23 October 2025, which deals with a very common issue in immigration law practice: the conversion of a residence permit for special protection into a residence permit for subordinate employment. The case concerned a foreign national who had entered Italy as an unaccompanied minor. Over time, he obtained a residence permit for special protection and, after reaching adulthood, he applied for the conversion of that permit into a residence permit for employment. However, the Police Headquarters of Trento rejected the request. The decision was mainly based on a criminal conviction and on several police reports which, according to the administration, demonstrated social dangerousness and an insufficient level of integration within Italian society. The applicant challenged this decision before the administrative court. He argued that the administration should have conducted a more careful assessment of his personal circumstances and, in particular, should have transmitted the case to the Territorial Commission in order to verify whether the conditions for special protection were still present. The administrative court, however, considered the decision of the Police Authority to be lawful and rejected the appeal. According to the judges, the administration had provided an adequate justification for the refusal, taking into account both the criminal record and the overall assessment of the applicant’s integration. This decision confirms an important legal principle: the conversion of a residence permit is not automatic. It always requires a comprehensive assessment of the foreign national’s situation, including aspects related to public security and social integration.
