New on TikTok: العودة إلى إيطاليا بعد الطرد: موقف مجلس الدولة صباح الخير، أنا المحامي فابيو لوتشيربو، وهذا حلقة جديدة من بودكاست قانون الهجرة. في هذه الحلقة نتناول موضوع الإذن بالعودة إلى إيطاليا بعد الطرد، بالاستناد إلى رأي صادر عن مجلس الدولة الإيطالي، الدائرة الأولى، في شهر ديسمبر 2025، وذلك في إطار طعن استثنائي مقدم إلى رئيس الجمهورية. تتعلق القضية بمواطن أجنبي سبق أن صدرت بحقه عدة قرارات طرد، ثم تقدم بطلب للحصول على إذن للعودة إلى إيطاليا. وقد رفضت وزارة الداخلية الطلب، معتبرة أن مدة حظر الدخول المنصوص عليها في القانون لم تكن قد انتهت بعد، وأن الأسباب المقدمة، ولا سيما المتعلقة بالعمل، كانت عامة وغير مدعومة بأدلة كافية. استمر الطعن الاستثنائي لسنوات طويلة دون حسم، وذلك أيضًا بسبب تأخيرات وجمود إداري. ومع ذلك، قرر مجلس الدولة في النهاية الفصل في القضية، متناولًا الجوانب الإجرائية وموضوع الطلب معًا. من الناحية الإجرائية، أوضح مجلس الدولة أنه في حال عدم وجود دليل قاطع على تاريخ تقديم الطعن في الخارج، لا يمكن اعتباره غير مقبول بسبب فوات الأجل. ففي مثل هذه الحالات، لا يجوز تحميل مقدم الطلب تبعات حالة عدم اليقين. أما من حيث الموضوع، فقد كان الموقف واضحًا. أكد مجلس الدولة أن الأجنبي الذي تم طرده لا يمكنه العودة إلى إيطاليا دون إذن خاص، وأن حظر العودة يطبق عادة لمدة طويلة. وإذا لم تنتهِ هذه المدة بعد، فإن قرار الرفض الصادر عن الإدارة يكون مشروعًا تمامًا. كما شدد المجلس على أن الإذن بالعودة هو قرار تقديري بيد الإدارة. وهذا يعني أن الإشارة إلى العمل أو الاندماج أو السلوك القانوني السابق لا تكفي وحدها للسماح بالعودة. فإذا كان حظر الدخول لا يزال ساريًا، يحق للإدارة الرفض، ويكون من الصعب الطعن في هذا القرار. الرسالة واضحة ويجب قولها دون لبس: العودة إلى إيطاليا بعد الطرد ليست حقًا مكتسبًا ولا طريقًا مختصرًا. احترام القانون والآجال المحددة فيه يأتي أولًا، وبعد ذلك فقط يمكن النظر في الظروف الفردية. هذا كل شيء لليوم. تابعوا بودكاست قانون الهجرة. إلى اللقاء في حلقة قادمة.
